  5.     Could the Bush Administration's savings and loan bailout get
  6. any messier? Yes, in ways never imagined. In a surprise court
  7. victory last week, the ailing Olympic Federal Savings of
  8. Berwyn, Ill., convinced federal Judge Royce Lamberth that the
  9. Government's Office of Thrift Supervision currently has no
  10. power to seize the S&L. Reason: acting OTS director Salvatore
  11. Martoche and his predecessor, M. Danny Wall, were never
  12. constitutionally appointed to their posts.

  14.     The decision could invite lawsuits from other insolvent S&Ls
  15. seeking to avoid seizure by OTS. But the agency has received
  16. temporary permission to continue taking over bankrupt thrifts
  17. pending an appeal. Meanwhile, the Bush Administration moved
  18. quickly to nominate T. Timothy Ryan, a former top Government
  19. lawyer, as the new OTS chief and urged the Senate to expedite
  20. approval.
